Terms of Service

These Terms of Service ("Terms") govern your use of Kill the Clipboard ("the Service"), a web-based tool for scanning SMART Health Link QR codes and routing health data to configured destinations.

1. Acceptance of Terms

By registering an organization or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

Kill the Clipboard provides healthcare organizations with the ability to:

• Scan SMART Health Link QR codes to extract patient health records
• Route extracted FHIR data and PDF documents to configured destinations including Google Drive, OneDrive, Box, email, FHIR servers, and API endpoints
• Send health records via connected Gmail or Microsoft Outlook accounts
• Manage organization-level settings and user access

3. Account Responsibilities

• You are responsible for maintaining the security of your organization's admin and staff passwords.
• You are responsible for all activity that occurs under your organization's account.
• You must notify us immediately of any unauthorized use of your account.
• You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations, including HIPAA where applicable.

4. Acceptable Use

You agree to use the Service only for its intended purpose of processing and routing health records. You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to other organizations' data or settings
• Interfere with or disrupt the Service or its infrastructure
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Use the Service to transmit malware or malicious content

5. Third-Party Services

The Service integrates with third-party services (Google Drive, Gmail, OneDrive, Outlook, Box). Your use of these integrations is also subject to the respective terms of service of those providers. We are not responsible for the availability or conduct of third-party services.

6. Health Data and HIPAA

The Service is designed to support HIPAA-compliant workflows. However:

• Organizations are responsible for their own HIPAA compliance, including executing any necessary Business Associate Agreements with their email and storage providers.
• The Service processes health data transiently and does not permanently store patient health information.
• Organizations are responsible for ensuring that their configured destinations and email accounts meet their compliance requirements.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform maintenance or updates that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

8. Limitation of Liability

To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

9. Termination

Either party may terminate use of the Service at any time. We reserve the right to suspend or terminate accounts that violate these Terms. Upon termination, we will delete your organization's configuration data and revoke any stored OAuth tokens.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
